3. Free Digital Growth Check Tool
The Digital Growth Check tool on our website provides AI-generated estimates of a business's digital presence. These scores are indicative only and based on AI inference, not a live technical audit or real-time data. Results should not be relied upon as professional advice. PinPoint Local AI accepts no liability for decisions made based on the output of this tool.
4. Payment Terms
Payment terms will be specified in your project agreement or invoice. Unless otherwise agreed:
- A deposit may be required before work commences
- Final payment is due on or before project delivery
- Invoices are payable within 14 days of issue
- Late payments may incur interest at the rate of 2% per month on the outstanding balance
5. Intellectual Property
Upon receipt of full payment, the client owns the final delivered website files and content created specifically for their project. PinPoint Local AI retains the right to display the work in its portfolio unless otherwise agreed in writing.
Any third-party tools, templates, plugins, fonts, or stock assets used in a project remain subject to their own licences. We will advise you of any ongoing licensing obligations.
6. Client Responsibilities
To enable us to deliver your project, you agree to:
- Provide accurate and complete information, content, and materials in a timely manner
- Provide feedback and approvals within agreed timeframes
- Ensure you hold all necessary rights to any content or materials you provide to us
- Not use our services for any unlawful purpose
7. Revisions and Scope
The number of revision rounds included will be specified in your project agreement. Work outside the agreed scope may be quoted separately. Significant changes to project requirements after work has commenced may affect timeline and pricing.
8. Limitation of Liability
To the maximum extent permitted by New Zealand law, PinPoint Local AI's total liability to you for any claim arising from or related to our services is limited to the amount you paid us for the specific service giving rise to the claim.
We are not liable for any indirect, incidental, special, or consequential damages, including loss of revenue, loss of data, or loss of business opportunity.
9. Warranties and Disclaimers
We will perform our services with reasonable care and skill. However, we do not guarantee specific outcomes such as search engine rankings, lead volumes, or revenue increases, as these depend on many factors outside our control.
Our website and the Digital Growth Check tool are provided "as is" without warranty of any kind.
10. Confidentiality
We treat all client information as confidential and will not disclose it to third parties except as required to deliver your project or as required by law.
11. Termination
Either party may terminate an engagement by providing written notice. In the event of termination, you are liable for payment for all work completed up to the date of termination. Any deposit paid is non-refundable unless otherwise agreed.
12. Governing Law
These Terms and Conditions are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. The current version will always be available on this page. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
